Consumer Portal Terms of Use

These Consumer Portal Terms of Use (“Terms”) govern your access to and use of the Western Mercantile Agency, Inc. (“WMA,” “we,” “our,” or “us”) online consumer portal (the “Portal”). Please read these Terms carefully before using the Portal.

1. Acceptance of Terms

By accessing or using this Portal, you acknowledge and agree to be bound by these Terms, our Privacy Notice, and any additional policies or disclosures made available through the Portal.

If you do not agree to these Terms, you may not access or use the Portal.

2. Portal Access and Eligibility

The Portal is intended solely for individuals with an account placed with Western Mercantile Agency, Inc., or other authorized users.

Unauthorized access or use of the Portal is strictly prohibited.

Use of this Portal does not create any new contractual relationship beyond the obligations associated with the underlying account.

3. User Responsibilities

By using the Portal, you agree to:

  • Use the Portal only for lawful purposes

  • Provide accurate, current, and complete information

  • Maintain the confidentiality of your login credentials

  • Refrain from attempting to interfere with or compromise Portal security

  • Refraining from uploading unlawful, harmful, or inappropriate content

  • Notify WMA immediately if you suspect unauthorized access to your account or misuse of the Portal

You are responsible for all activities conducted through your account.

4. Communications and Consent

By using the Portal and providing your contact information, you consent to receive communications from WMA electronically, including by email, telephone, SMS/text message, or other lawful means.

Such communications may include automated or artificial voice systems, as further described in our TCPA and E-SIGN disclosures.

5. AI and Automated Interactions

WMA may utilize chatbots, AI-assisted tools, or other automated technologies to facilitate communications and provide support through the Portal.

These automated systems may simulate human interaction, but are not live agents. You may request to speak with a live representative at any time.

6. Intellectual Property

All content, trademarks, logos, software, and materials displayed or made available through the Portal are the property of WMA or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from Portal content without prior written authorization from WMA.

7. Limitation of Liability

To the fullest extent permitted by law, WMA shall not be liable for any indirect, incidental, special, consequential, or punitive damage arising from or related to your use of, or inability to use, the Portal.

The Portal is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

Nothing in these Terms limits any rights that may not be waived under applicable consumer protection laws.

8. Third-Party Services

The Portal may contain links to, or integrations with, third-party service providers, including payment processors and communication vendors.

WMA is not responsible for the content, practices, or privacy policies of third parties. Use of third-party services is at your own discretion and subject to their respective terms.

9. Suspension or Termination of Access

WMA reserves the right to suspend or terminate Portal access at any time, in its sole discretion, without prior notice, if we believe your conduct violates these Terms or applicable law.

10. Updates and Modifications

WMA may revise these Terms at any time. Updated Terms will be posted through the Portal with a revised effective date.

Your continued use of the Portal following such updates constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of Oregon, without regard to conflict of law principles.

Any dispute arising out of or relating to the Portal shall be resolved through arbitration or in a court of competent jurisdiction located in Oregon, as applicable.

12. Payment Posting Policy

Payments submitted through the Portal are applied on a First-In, First-Out (“FIFO”) basis unless you provide specific written designation and such designation is confirmed by WMA.

If you wish to apply a payment to a specific account or balance, you must contact our office before or immediately after submitting payment to ensure proper designation.
